1. Introduction and Acceptance of Terms
1.1. Welcome to Buenainfo.net (the "Website"), owned and operated by Gustavo Cardozo, Tax ID 20282622336, with a registered address at Salta Capital, Argentina, an Expert Developer in Artificial Intelligence solutions (hereinafter referred to as "Buenainfo.net" or the "Owner"). These Terms govern your access to and use of the Website, including any content, functionality, and services offered on or through Buenainfo.net (collectively, the "Website Services"). The specific services of AI Agents (the "AI Services") are additionally governed by separate contractual agreements signed by the Owner. 1.2. By accessing or using the Website, you ("User," "You") agree that you have read, understood, and are legally bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree with any of these Terms, you must not access or use the Website.
2. Key Definitions
2.1. "AI Agents" or "AI Services": Refers to the technological solutions offered by Buenainfo.net that use artificial intelligence to provide automated customer support services, as described on the Website and, in more detail, in specific Service Agreements. 2.2. "Content": Includes all text, graphics, images, music, software (excluding the AI Services themselves under a separate agreement), audio, video, information, or other materials available on or through the Website. 2.3. "User": Any person who accesses or uses the Website. 2.4. "Client": An entity or individual who has entered into a separate Service Agreement with Buenainfo.net for the use of the AI Services. 2.5. "Service Agreement": The specific and binding contract signed between Buenainfo.net and a Client that details the terms, conditions, scope, service level agreements (SLAs), fees, and other specifications for the provision and use of the AI Services.
3. Modification of Terms
3.1. Buenainfo.net reserves the right, in its sole discretion, to revise and update these Terms at any time. All changes are effective immediately when posted on the Website and apply to all subsequent access to and use of the Website. 3.2. Your continued use of the Website following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page periodically so you are aware of any changes, as they are binding on you.
4. Website Access and Use
4.1. Permitted Use: You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Website strictly for informational purposes, to evaluate the AI Services, and to make contact regarding such services, subject to these Terms. 4.2. Prohibited Conduct: You agree not to use the Website: a. In any way that violates any applicable local, provincial, national, or international law or regulation. b. To transmit, or procure the sending of, any unsolicited advertising or promotional material ("spam"). c. To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Website, or which, as determined by the Owner, may harm Buenainfo.net or users of the Website or expose them to liability. d. To use any robot, spider, or other automatic device, process, or means to access the Website for any purpose, including monitoring or copying any of the material on the Website. e. To introduce any viruses, trojan horses, or other material which is malicious or technologically harmful. f. To attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Website, the server on which the Website is stored, or any server, computer, or database connected to the Website.
5. Description of AI Services (Informational)
5.1. The Website provides information about the AI Services, which include AI Agents designed to enhance customer support, optimize costs, and increase operational efficiency for Clients. 5.2. The key features, benefits, and processes described on the Website (such as analysis, custom design, implementation, optimization, 24/7 support, natural conversations, etc.) are representative of the AI Services offered. 5.3. Important: The description of the AI Services on the Website is for general informational purposes only. The actual provision, scope, specific functionalities, service level agreements (SLAs), fees, and all other applicable conditions for the use of the AI Services by a Client shall be governed exclusively by the Service Agreement signed between Buenainfo.net and said Client.
6. Specific Service Agreements
6.1. The use of the AI Agents and the associated implementation, support, and optimization services is strictly subject to the execution of a written Service Agreement between the Client and Buenainfo.net. 6.2. These Website Terms do not grant any right to use the AI Services. In the event of any conflict between these Website Terms and a signed Service Agreement, the Service Agreement shall prevail with respect to the use of the AI Services.
7. Intellectual Property Rights
7.1. Website Content: The Website and its entire Content, features, and functionality are owned by Buenainfo.net, its licensors, or other providers of such material and are protected by Argentinian and international copyright (Law 11.723), trademark, patent, trade secret, and other intellectual property or proprietary rights laws. No right, title, or interest in or to the Website or any Content on the Website is transferred to you. 7.2. AI Services Technology: The underlying technology, algorithms, software, and related intellectual property of the AI Agents are the exclusive property of Buenainfo.net and/or its licensors. The rights to use this technology by Clients are strictly defined in the Service Agreements. 7.3. Copyright Notice: In accordance with Law No. 11.723, if you believe your copyright is being infringed, please notify [email protected]. For the takedown notice to be valid and constitute actual knowledge, you must provide: your contact information, signature, proof of ownership of the work, specific location of the content, and a statement confirming the accuracy of the report and that the use of the content is not authorized. Consequently, we will proceed with the removal or blocking of said content.
8. Client Data and Privacy
8.1. Website Data: The collection and use of personal information obtained through the Website (e.g., via contact forms) is governed by our Privacy Policy. This policy complies with the Argentinian Personal Data Protection Law No. 25.326. 8.2. Data Processed by AI Services: The processing of any data (including personal data of the Client's end-users) by the AI Agents on behalf of a Client shall be strictly governed by the terms of the applicable Service Agreement and an associated Data Processing Addendum (DPA), in accordance with Law 25.326 and other applicable data protection laws.
9. Confidentiality
9.1. Any information shared by a User or potential Client with Buenainfo.net through the Website or during initial consultations will be treated as confidential to the extent permitted by law and the Privacy Policy. 9.2. Mutual confidentiality obligations regarding information shared in the context of providing the AI Services will be detailed in the Service Agreement.
10. Client Responsibilities
10.1. Clients using the AI Services will have specific responsibilities detailed in their Service Agreement, which may include, but are not limited to: providing accurate information for setup, ensuring their use of the AI Services complies with all applicable laws and cooperating with Buenainfo.net for implementation and optimization.
11. Fees and Payment
11.1. Access to the Website is free of charge. 11.2. Fees for the use of the AI Services, payment terms, billing, and any other financial aspects will be established exclusively in the Service Agreement signed between Buenainfo.net and the Client.
12. Links to Third-Party Websites
12.1. The Website may contain links to other sites and resources provided by third parties. These links are provided for your convenience only. The Owner has no control over the contents of those sites or resources and accepts no responsibility for them or for any loss or damage that may arise from your use of them.
13. Disclaimer of Warranties
13.1. Website Use: Your use of the Website, its content, and any services obtained through the Website is at your own risk. The Website and its content are provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied. 13.2. AI Services: Specific warranties related to the performance, availability, and functionality of the AI Services will be set forth, if any, exclusively in the signed Service Agreement with the Client. Marketing statements on the Website (e.g., regarding "excellence," "increased profits," "cost optimization") describe the service's potential goals and benefits but do not constitute contractually binding guarantees outside of a Service Agreement.
14. Limitation of Liability
14.1. Regarding Website Use: To the fullest extent permitted by applicable law, in no event will Buenainfo.net, its agents, or contractors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, the Website, any websites linked to it, or any content on the Website. 14.2. Regarding AI Services: The limitations of liability applicable to the provision and use of the AI Services will be detailed specifically in the Service Agreement signed between Buenainfo.net and the Client.
15. Indemnification
15.1. You agree to defend, indemnify, and hold harmless Buenainfo.net, its contractors, agents, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms or your use of the Website.
16. Termination
16.1. Buenainfo.net may terminate or suspend your access to all or part of the Website for any or no reason, including without limitation, any violation of these Terms, at its sole discretion and without prior notice. 16.2. The termination of the provision of the AI Services will be governed by the terms of the applicable Service Agreement.
17. Governing Law and Jurisdiction
17.1. All matters relating to the Website and these Terms shall be governed by and construed in accordance with the internal laws of the Argentine Republic. 17.2. Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Website shall be instituted exclusively in the competent ordinary courts located in the Autonomous City of Buenos Aires, Argentine Republic.
18. Miscellaneous
18.1. Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions will continue in full force and effect. 18.2. Entire Agreement: These Terms and our Privacy Policy constitute the sole and entire agreement between you and Buenainfo.net regarding the Website. 18.3. Waiver: No waiver by Buenainfo.net of any term or condition set forth in these Terms shall be deemed a further or continuing waiver.
